Surge Cup Official Terms and Conditions

Effective Date: December 6, 2025

Please read these terms carefully before participating in the Surge Cup competition.

1. OVERVIEW AND ACCEPTANCE

The Surge Cup ("Competition") is a weekly simulated trading competition organized and operated by SurgeOptions ("Company," "we," "us," or "our"). By participating in the Competition, you ("Participant," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Official Terms and Conditions ("Terms").

Your participation in the Competition constitutes your full and unconditional agreement to these Terms and any decisions made by SurgeOptions, which are final and binding in all matters related to the Competition. If you do not agree to these Terms, you must not participate in the Competition.

SurgeOptions reserves the right to modify, suspend, or terminate the Competition or these Terms at any time, for any reason, without prior notice or liability. Continued participation following any such changes constitutes your acceptance of the modified Terms.

2. ELIGIBILITY REQUIREMENTS

To be eligible to participate in the Surge Cup Competition, you must meet all of the following criteria:

2.1 Account Registration. You must have a valid, registered account with SurgeOptions. All registered Surge Traders are automatically entered into the Competition upon the commencement of each Competition period.

2.2 Age Requirement. You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, whichever is greater.

2.3 Geographic Restrictions. The Competition is void where prohibited by law. Participants are solely responsible for determining whether their participation is lawful in their jurisdiction. Residents of countries where simulated trading competitions or the prizes offered are prohibited or restricted by law are not eligible to participate or receive prizes.

2.4 No Purchase Necessary. No purchase, subscription, or payment of any kind is required to participate in the Competition. Participation is free for all registered Surge Traders.

2.5 One Entry Per Person. Each Participant may only participate using one (1) SurgeOptions account. Multiple accounts, duplicate entries, or any attempt to participate using multiple identities will result in immediate disqualification from the Competition and may result in permanent suspension of all associated accounts.

3. COMPETITION PERIOD AND STRUCTURE

3.1 Competition Duration. The Surge Cup Competition for December 2025 will commence on Monday, December 8, 2025, at 9:30 AM Eastern Time (ET) and will conclude on Friday, December 12, 2025, at 4:00 PM Eastern Time (ET) ("Competition Period").

3.2 Trading Hours. All simulated trading activity must occur during regular market hours. Positions must be managed in accordance with standard SurgeOptions trading rules, including but not limited to the requirement that all positions be closed by 4:00 PM ET each trading day.

3.3 Starting Conditions. All Participants will begin the Competition with a simulated account balance as determined by SurgeOptions. The specific starting balance and trading parameters will be communicated to Participants prior to the Competition commencement.

3.4 Ranking Determination. Final rankings will be determined based on the highest simulated account balance at the conclusion of the Competition Period. In the event of a tie, the Participant who achieved the higher balance first (based on timestamp) will be ranked higher.

4. COMPETITION RULES AND TRADING PARAMETERS

4.1 Drawdown Limit. A Two Thousand Dollar ($2,000) End-of-Day (EOD) trailing drawdown applies to all Competition accounts. The drawdown is calculated based on the highest account balance achieved and trails upward as the account balance increases.

4.2 Drawdown Breach. If a Participant's account balance falls below the trailing drawdown threshold at any point during the Competition, the Participant will be immediately disqualified from prize eligibility. Disqualified Participants may continue to trade for educational purposes but will not be eligible to receive any prizes.

4.3 No Profit Target. Unlike standard SurgeOptions evaluation accounts, the Competition does not impose a profit target requirement. Participants are free to trade according to their own strategies without the constraint of meeting a specific profit goal.

4.4 Prohibited Activities. The following activities are strictly prohibited and will result in immediate disqualification:

  • Manipulation of trading data or account information
  • Exploitation of platform errors, bugs, or vulnerabilities
  • Coordinated trading between multiple accounts
  • Use of automated trading systems unless expressly permitted
  • Any form of cheating, fraud, or deceptive practices
  • Violation of any SurgeOptions platform rules or Terms of Service
  • Any activity that SurgeOptions, in its sole discretion, deems to be contrary to the spirit of fair competition

4.5 Platform Rules. All standard SurgeOptions trading rules and platform Terms of Service remain in effect during the Competition unless expressly modified by these Terms.

5. PRIZES AND AWARDS

5.1 First Place Prize - Live Trading Account. The Participant who achieves the highest eligible account balance at the conclusion of the Competition Period will be awarded access to a live trading account funded with Two Thousand Dollars ($2,000) in trading capital, subject to the following conditions:

  • Balance Requirement: The winning Participant must conclude the Competition with a simulated account balance of at least Fifty-Two Thousand Dollars ($52,000) without having breached the drawdown limit at any point during the Competition.
  • Brokerage Account Requirement: The winner must open their own individual brokerage account with tastytrade. This account must be opened separately by the winner and is subject to tastytrade's account opening requirements, approval process, and terms of service. The winner is not required to fund the account, and the winner will not be trading in the account themselves.
  • Account Type Restriction: Only individual tastytrade accounts are eligible for the live trading prize. Joint accounts, entity accounts (LLC, Corporation, Partnership, etc.), trust accounts, and retirement accounts (IRA, Roth IRA, 401(k), etc.) are not eligible and will not be accepted.
  • Limited Trading Authorization (LTA): The winner must sign a Limited Trading Authorization (LTA) agreement granting SurgeOptions or its designated trading manager authority to execute trades on behalf of the winner in their tastytrade account. The LTA is required before any live trading capital can be deposited or trading can commence.
  • Verification: The winner must complete identity verification and any other documentation required by SurgeOptions and/or tastytrade before the prize can be awarded, including but not limited to the LTA and any forms required by tastytrade for third-party trading authorization.
  • Prize Forfeiture: If the first-place winner does not meet all eligibility requirements, fails to complete required documentation within thirty (30) days of notification, or is otherwise unable or unwilling to accept the prize, the prize will be forfeited and may be awarded to the next eligible Participant at SurgeOptions' sole discretion.

5.2 Top Twenty Prize - Free Evaluation Account. Participants who finish in positions two (2) through twenty-one (21) (i.e., the top twenty Participants excluding the first-place winner) will each receive one (1) free SurgeOptions Evaluation Account, subject to the following conditions:

  • The Participant must not have breached the drawdown limit during the Competition
  • The Participant must have actively traded during the Competition Period
  • The free Evaluation Account will be credited to the winner's SurgeOptions account within seven (7) business days following the conclusion of the Competition
  • The Evaluation Account is subject to standard SurgeOptions Evaluation Account terms and conditions

5.3 Prize Limitations. All prizes are non-transferable, non-exchangeable, and have no cash value. Prizes cannot be sold, assigned, or transferred to any third party. SurgeOptions reserves the right to substitute prizes of equal or greater value at its sole discretion.

5.4 Taxes. Winners are solely responsible for all applicable federal, state, local, and foreign taxes associated with receipt of any prize. SurgeOptions may require winners to complete and submit tax forms (such as IRS Form W-9) before prizes can be awarded.

6. WINNER NOTIFICATION AND VERIFICATION

6.1 Notification. Potential winners will be notified via the email address associated with their SurgeOptions account within forty-eight (48) hours following the conclusion of the Competition Period. It is the Participant's responsibility to ensure their contact information is current and accurate.

6.2 Verification Process. Potential winners may be required to complete an affidavit of eligibility, a liability release, and any other documentation deemed necessary by SurgeOptions. Failure to complete required documentation within the specified timeframe may result in prize forfeiture.

6.3 Public Announcement. By participating in the Competition, you consent to the public announcement of winners, including display of usernames, rankings, and performance statistics. If you wish to remain anonymous, you must notify SurgeOptions in writing prior to the Competition commencement.

7. DISQUALIFICATION

SurgeOptions reserves the right, in its sole and absolute discretion, to disqualify any Participant who:

  • Violates these Terms or any SurgeOptions platform rules
  • Breaches the drawdown limit during the Competition
  • Engages in any prohibited activity as defined in Section 4.4
  • Tampers with the Competition or attempts to undermine its integrity
  • Acts in an unsportsmanlike or disruptive manner
  • Provides false, misleading, or fraudulent information
  • Is found to have multiple accounts or entries
  • Engages in any conduct that SurgeOptions deems harmful to the Competition, other Participants, or SurgeOptions' reputation

Disqualification decisions are final and not subject to appeal. Disqualified Participants forfeit any claim to prizes and may be subject to additional penalties, including permanent account suspension.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SURGEOPTIONS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN THE COMPETITION, INCLUDING BUT NOT LIMITED TO:

  • Any technical malfunctions, errors, or failures
  • Lost, late, incomplete, or corrupted entries or data
  • Any injury or damage resulting from participation
  • Any errors in the administration of the Competition or announcement of winners
  • Any loss of profits, revenue, or anticipated savings

SURGEOPTIONS' TOTAL LIABILITY SHALL NOT EXCEED THE VALUE OF THE PRIZE FOR WHICH THE PARTICIPANT IS ELIGIBLE.

9. INDEMNIFICATION

By participating in the Competition, you agree to indemnify, defend, and hold harmless SurgeOptions, its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your participation in the Competition, your violation of these Terms, or your violation of any rights of any third party.

10. DISPUTE RESOLUTION

10.1 Governing Law. These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.

10.2 Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Competition shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

10.3 Class Action Waiver. You agree that any claims shall be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

11. GENERAL PROVISIONS

11.1 Entire Agreement. These Terms constitute the entire agreement between you and SurgeOptions regarding the Competition and supersede all prior agreements and understandings.

11.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11.3 Waiver. The failure of SurgeOptions to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

11.4 Force Majeure. SurgeOptions shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

12. ACKNOWLEDGMENT

BY PARTICIPATING IN THE SURGE CUP COMPETITION, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU FURTHER ACKNOWLEDGE THAT THE COMPETITION INVOLVES SIMULATED TRADING AND THAT PAST SIMULATED PERFORMANCE IS NOT INDICATIVE OF FUTURE RESULTS IN LIVE TRADING. YOU UNDERSTAND THAT TRADING OPTIONS INVOLVES SUBSTANTIAL RISK OF LOSS AND IS NOT SUITABLE FOR ALL INVESTORS.
